Terms & Conditions

The terms on which BTT Byraveshwara Tours & Travels accepts bookings and provides transport services.

Please read these terms before booking. They set out how bookings are confirmed, how fares and cancellations work, what we are responsible for and what we are not, and how to raise a complaint.

1. Who These Terms Apply To

These terms and conditions govern the transport services provided by Byraveshwara Tours & Travels (“BTT”, “we”, “us”), registered at #259, Navya Layout, Hennagara (P), Jigani, Anekal Taluk, Bengaluru, Karnataka – 560105.

They apply to every person who books, pays for or travels in a BTT vehicle, whether the booking is made by an individual passenger or by an organisation on its employees’ behalf. By making a booking or boarding a vehicle you accept these terms.

Where BTT and a corporate client have signed a separate service agreement, that agreement takes precedence over these terms to the extent of any conflict. These terms continue to apply to everything the agreement does not cover.

2. Definitions

  • Booking — a confirmed request for transport, whether one-off or recurring under a contract.
  • Client — the individual or organisation responsible for payment.
  • Passenger — any person travelling in a BTT vehicle.
  • Services — employee transportation, airport transfers, local and outstation rentals, corporate shuttle, school transportation and EV segment services.
  • Trip — a single journey from a stated pick-up point to a stated drop point.

3. Bookings And Confirmation

A booking is only binding on BTT once we have confirmed it in writing — by email, through an agreed booking platform, or in a signed contract schedule. A request that has been sent but not acknowledged is not a confirmed booking.

The Client is responsible for the accuracy of the details supplied: pick-up and drop addresses, date and time, passenger count, contact number, and any requirement such as a child seat, wheelchair access or a specific vehicle category. BTT is not liable for a failed trip caused by incorrect or incomplete booking information.

Changes To A Confirmed Booking

Changes are accepted subject to vehicle and driver availability. A change requested less than [ notice period ] before the scheduled pick-up may be treated as a cancellation and a fresh booking, and charged accordingly.

4. Fares, Billing And Payment

Fares are quoted either against a published rate card, a rate agreed in a corporate contract, or a written quotation for a specific trip. Unless the quotation states otherwise, the fare covers the vehicle, the driver and fuel.

The following are charged in addition where they arise, at actuals or at the rate stated in the applicable rate card:

  • Toll charges, inter-state permits, parking and entry fees.
  • Driver allowance for night duty and for outstation trips involving an overnight halt.
  • Distance or hours used beyond the package booked.
  • Waiting time beyond the free allowance in clause 6.
  • Applicable taxes, charged at the prevailing statutory rate.

Corporate clients are invoiced on the cycle set out in their contract. Invoices are payable within [ payment terms ] of the invoice date. BTT reserves the right to charge interest on overdue amounts at the rate stated in the contract, and to suspend services on an account that remains overdue after written notice.

5. Cancellations And No-Shows

Cancellation charges depend on how much notice is given before the scheduled pick-up time:

  • More than [ X ] hours’ notice — no charge.
  • Between [ Y ] and [ X ] hours — [ % ] of the trip fare.
  • Less than [ Y ] hours, or a no-show — the full trip fare.

A passenger who has not boarded within the free waiting period, and cannot be reached on the contact number supplied, is treated as a no-show.

Recurring services under a corporate contract follow the notice periods in that contract, not this clause.

6. Waiting Time

A free waiting allowance applies from the confirmed pick-up time: [ n ] minutes for local pick-ups and [ n ] minutes for airport pick-ups, measured from flight arrival rather than from the booked time where a flight number has been supplied. Waiting beyond the allowance is charged at the applicable rate card rate, rounded to the nearest [ unit ].

Where BTT is late to the pick-up point for reasons within our control, no waiting charge applies and the delay is recorded against the trip.

7. Passenger Conduct And Safety

Passengers must wear seatbelts where fitted and follow the driver’s reasonable instructions on safety. The driver is responsible for the safe operation of the vehicle and may decline to move it until safety requirements are met.

The following are not permitted in any BTT vehicle:

  • Smoking, alcohol consumption, or the carriage or use of illegal substances.
  • Carriage of hazardous, flammable or prohibited goods.
  • Behaviour that is abusive, threatening, or unsafe to the driver or other passengers.
  • Exceeding the vehicle’s licensed seating capacity.

A driver may end a trip where any of the above occurs. In that event the full fare remains payable, and the Client is responsible for the cost of cleaning or repairing any damage caused by a passenger beyond fair wear and tear.

Children

Children must travel with an appropriate restraint where the law requires one. Child seats must be requested at the time of booking. On school transportation services, children are released only to a person authorised in writing by the school or the parent or guardian.

8. Luggage And Personal Property

Luggage is carried subject to the vehicle’s capacity. Where the quantity or size of luggage has not been declared at booking, BTT may be unable to carry it and the trip may proceed without it.

Personal property is carried at the passenger’s own risk. BTT is not liable for loss of or damage to items left in a vehicle, but will make reasonable efforts to return recovered property. Unclaimed items are held for [ retention period ] and then disposed of.

9. Vehicles And Substitution

BTT allocates a vehicle of the category booked. We may substitute a vehicle of equivalent or higher category where operationally necessary — for example after a breakdown or a driver becoming unavailable — without additional charge to the Client.

A specific make, model, registration or colour is not guaranteed unless it has been expressly agreed in writing.

All vehicles are maintained in accordance with the applicable statutory requirements and carry valid registration, fitness, permit, pollution and insurance documentation.

10. Delays And Circumstances Beyond Our Control

BTT plans routes and timings to meet the confirmed schedule, but does not guarantee arrival at a particular time where the cause of a delay lies outside our control. This includes traffic congestion, road closures, accidents, weather, civil disturbance, strikes or bandhs, government or police restrictions, and acts of God.

Where a delay arises from a cause within our control, the remedy is as set out in clause 12 or, for corporate clients, in the service levels of the applicable contract.

Passengers with a time-critical commitment — a flight, a train, an examination — should build in an adequate buffer. BTT is not liable for consequential losses arising from a missed connection.

11. Insurance

All BTT vehicles carry motor insurance as required by law, and passengers are covered to the extent provided by that policy and by any additional cover BTT maintains. Cover is subject to the terms, conditions and limits of the relevant policy.

Clients who require cover beyond the statutory minimum should confirm the requirement in writing before the service commences so that it can be arranged and priced.

12. Liability

Nothing in these terms excludes or limits BTT’s liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

Subject to that, and to the extent permitted by law:

  • BTT’s total liability arising out of or in connection with a trip is limited to [ liability cap ].
  • BTT is not liable for indirect or consequential loss, including loss of profit, loss of business or missed connections.
  • BTT is not liable for loss arising from information supplied by the Client that was incorrect or incomplete.

13. Data Protection

To provide the Services, BTT collects and processes personal data including names, contact numbers, pick-up and drop addresses, trip timings and vehicle location. We use it to plan and operate trips, to bill, to meet safety and statutory obligations, and to investigate incidents and complaints.

Data is shared with drivers and operational staff only to the extent needed to run the trip, and with a corporate Client where the trip is made under that Client’s contract. We do not sell personal data.

Vehicles may be fitted with GPS tracking and, where applicable, in-vehicle cameras, operated for safety, route verification and incident investigation.

14. Complaints And Grievance Redressal

Complaints should be raised as soon as possible, and in any event within [ complaint window ] of the trip, so that trip records and vehicle data are still available for investigation. We acknowledge complaints within [ n ] working days and aim to resolve them within [ n ] working days. Safety-related complaints are escalated immediately.

15. Suspension And Termination

BTT may refuse or withdraw service where a passenger’s conduct endangers the driver, other passengers or the vehicle, where an account remains overdue after written notice, or where a booking has been made fraudulently.

Either party may terminate a corporate contract in accordance with the notice provisions of that contract. Termination does not affect any amount already due, or any right or liability that accrued before termination.

16. Changes To These Terms

BTT may update these terms from time to time. The version published on this page at the time a booking is confirmed is the version that applies to that booking. The date of the current version is shown at the top of this page.

Material changes affecting corporate clients will be notified in writing in accordance with the applicable contract.

17. Governing Law And Jurisdiction

These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or in connection with them.

The parties will attempt in good faith to resolve any dispute through discussion before commencing proceedings.
